* You are responsible for ensuring all persons accessing the Website through your internet connection are aware of these Terms.
* You must not misuse our Website by knowingly introducing viruses or other malicious material.
4. Placing an Order & Formation of Contract
* Product listings on our Website constitute an invitation to treat, not an offer to sell.
* By placing an Order, you make an offer to purchase the Goods subject to these Terms.
* You must be at least 18 years old and capable of entering a binding contract to place an Order. We reserve the right to refuse orders where we suspect the purchaser is underage.
* You are responsible for ensuring the accuracy of your Order details (including personalisation requests).
* After placing your Order, you will receive an email acknowledging receipt ("Order Confirmation"). This is not acceptance of your offer.
* A legally binding Contract between you and us is formed only when we send you an email confirming that the Goods have been dispatched ("Dispatch Confirmation").
* We reserve the right to refuse or cancel any Order before Dispatch Confirmation for reasons including, but not limited to: Goods being unavailable, pricing errors, suspicion of fraud, inability to obtain authorisation for payment, or failure to meet eligibility criteria.
5. Pricing & Payment
* Prices displayed on the Website are in Pounds Sterling (£) and are inclusive of UK VAT (where applicable) but exclusive of delivery charges.
* We make every effort to ensure prices are accurate. However, errors may occur. If we discover an error in the price of Goods you ordered, we will inform you as soon as possible and give you the option to reconfirm your Order at the correct price or cancel it. If we cannot contact you, we will treat the Order as cancelled.
* Delivery charges will be clearly displayed during checkout and added to the total price.
* Payment must be made in full at the time of placing your Order via our secure payment gateway. We accept major credit/debit cards and potentially other methods as listed on the Website.
* Your card will be charged when we send the Dispatch Confirmation.
6. Delivery
* Delivery options, estimated timeframes, and costs will be presented during checkout and in your Order Confirmation.
* Estimated delivery times are indicative only and commence from the date of Dispatch Confirmation. We are not liable for delays caused by events outside our reasonable control (e.g., carrier delays, customs, severe weather, pandemics).
* Delivery will be completed when the Goods are delivered to the address you specified in your Order.
* You are responsible for ensuring the delivery address is correct and that someone is available to receive the Goods. We are not liable for loss or damage resulting from incorrect addresses or failed delivery attempts.
* Risk in the Goods passes to you upon delivery.
* Title (ownership) of the Goods passes to you only once we have received full payment of all sums due, including delivery charges.
7. Right to Cancel (Consumer Customers Only - UK)
* Important: This section applies only if you are a Consumer purchasing Goods from within the UK.
* Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the legal right to cancel your Contract within 14 days from the day after you receive the Goods (or the last item in a multiple-item order).
* Exemption for Pierced Earrings: Due to hygiene reasons, your right to cancel does not apply to pierced earrings if the hygiene seal is broken after delivery. You lose the right to cancel pierced earrings once the seal is broken.
* To exercise your right to cancel:
* You must inform us clearly of your decision to cancel (e.g., email, letter, or using the cancellation form available on our Website [Link to Form if available]).
* You must return the Goods to us within 14 days of informing us of cancellation.
* Goods must be returned unused, in their original, undamaged packaging, with all tags and certificates intact, and in a resaleable condition.
* You are responsible for the cost of returning the Goods unless they are faulty or we sent you incorrect Goods.
* Refunds after Cancellation:
* We will refund you the price paid for the Goods and the standard delivery cost (if any) within 14 days of:
* Receiving the Goods back; or
* Receiving proof you have sent the Goods back (whichever is sooner).
* We may withhold the refund until we receive the Goods or proof of return.
* We will make the refund using the same payment method you used for the original transaction.
* We may deduct an amount if the value of the Goods has been reduced due to unnecessary handling beyond what is necessary to establish the nature, characteristics, and functioning of the Goods.
8. Returns & Exchanges (Non-Cancellation)
* Outside the 14-day cancellation period, or for non-Consumer customers, returns or exchanges are only accepted if Goods are faulty, damaged in transit, or not as described.
* You must contact us within [e.g., 7 days] of receiving the Goods to report any faults, damage, or discrepancies.
* We reserve the right to inspect returned Goods. Refunds or exchanges will be issued at our discretion upon verification of the issue. Return shipping costs for faulty/damaged/incorrect items will be covered by us.
* We do not offer refunds or exchanges for change of mind outside the statutory cancellation period.
9. Faulty, Damaged or Incorrect Goods
* We are under a legal duty to supply Goods that are in conformity with the Contract.
* If Goods are faulty, damaged in transit, or not what you ordered, please contact us immediately (within [e.g., 7 days] of delivery) at [Customer Service Email/Phone].
* You have legal rights as a Consumer (including repair, replacement, price reduction, or refund). These rights are not affected by our returns policy.
* We will require proof of purchase and may request photos or the return of the Goods for inspection. We will cover the cost of returning faulty/damaged/incorrect Goods.
* Please see our [Link to Returns/Refunds Policy] for full details.
10. Product Descriptions & Images
* We make every effort to ensure the colours, finishes, and specifications of our Goods displayed on the Website are accurate. However, slight variations may occur due to screen settings, photography lighting, and the nature of natural materials (like gemstones).
* Product descriptions, weights (e.g., gold weight, carat), and dimensions are provided as accurately as possible but should be considered approximate.
* If a product is listed with an incorrect price or description due to an error, we reserve the right to refuse or cancel Orders as outlined in Section 4.
11. Personalised & Bespoke Goods
* Please check personalisation details (e.g., engraving text, initials) carefully before submitting your Order. We are not liable for errors in personalisation if the information you provided was incorrect.
* Due to their bespoke nature, personalised or custom-made items (items made specifically to your specifications) cannot be cancelled or returned after the Order has been placed, unless they are faulty. This is because they are made uniquely for you and cannot be resold.
12. Care & Maintenance
* Jewellery requires care. Specific care instructions will be provided with your Goods. We are not liable for damage resulting from improper care, wear, or accidental damage.
13. Liability
* We are liable to you for foreseeable loss and damage caused by our breach of these Terms or negligence. Loss or damage is foreseeable if it is obvious it will happen or if we were told about it at the time the Contract was formed.
* We do not exclude or limit liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of terms implied by the Consumer Rights Act 2015 (e.g., satisfactory quality, fitness for purpose); or any other liability which cannot be excluded or limited under English law.
* Subject to the above, our total liability to you arising under or in connection with any Contract shall be limited to the total price paid for the specific Goods giving rise to the liability.
* We are not liable for business losses (if you are a Consumer, we only supply Goods for domestic and private use).
14. Intellectual Property
* All content on the Website (text, graphics, logos, images, software) is our property or licensed to us and is protected by UK and international intellectual property laws. You may only use this content for personal, non-commercial purposes related to placing an Order.
15. Data Protection
* We process your personal data in accordance with our Privacy Policy [Link to Privacy Policy], which complies with the UK GDPR and Data Protection Act 2018.
16. Events Outside Our Control
* We are not liable for failure or delay in performing our obligations due to events beyond our reasonable control ("Force Majeure"), including strikes, lock-outs, failure of third-party suppliers, transport disruption, acts of God, war, terrorism, governmental action, or pandemic.
17. Governing Law & Jurisdiction
* These Terms, the Contract, and any dispute arising from them are governed by and construed in accordance with the laws of England and Wales.
* Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a Consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
18. Changes to Terms
* We reserve the right to amend these Terms at any time. The Terms in force at the time you place your Order will govern that Contract. Please check this page regularly for updates.
